Il Giusto Processo alla prova: spunti cinematografici

This article aims to reinforce a well-established concept within the legal-philosophical school of the University of Padua: “The trial is the place where conflict becomes controversy.” For this conversion to be possible, it is vital to preserve the dialogic nature of the proceedings. This raises a fundamental question: “Is adhering to the formalities of Due Process sufficient to enable true dialogue?”. To explore this inquiry, the article examines two recent films: Ron Howard’s Eden (2024) and Clint Eastwood’s Juror No. 2 (2024). Both works, though approaching the subject from different perspectives, highlight the indispensability of the dialogic dimension and demonstrate how it requires a substantially human element to be properly invoked.
